Terms of Sale

These terms and conditions are governed by Norwegian law and are intended to provide a clear overview of the rights and obligations between Cushion Day and our customers. By placing an order, you agree to these terms.

The Agreement

The agreement consists of these terms and conditions, the information provided at checkout, and any terms specifically agreed upon. In the event of any conflict between different parts of the agreement, these terms and conditions take precedence.

Price

All prices are stated in Norwegian kroner (NOK) and include VAT. The total cost, including shipping and any additional fees, will be displayed before you complete your purchase.

Conclusion of Agreement

The purchase is binding once you have registered your order. However, the purchase is not binding if there are obvious typographical or pricing errors that you should have understood were errors.

Payment

We accept the following payment methods:
Card payments: Visa/Mastercard
Mobile payments: Vipps
Invoice/Instalment payments: Klarna

Card amounts are reserved at the time of order and charged when the goods are shipped. Invoice payments have a 14-day due date. Customers under the age of 18 cannot pay by invoice.

Delivery

We use Posten/Bring as our delivery partner. Delivery is considered complete when the goods are handed over to you or someone authorized to receive them on your behalf. If no specific delivery time has been agreed, goods will be delivered within 30 days. We do not deliver to Svalbard or Jan Mayen.

Risk of the Goods

The risk of the goods passes to you when you receive them.

Right of Withdrawal and Extended Returns

In accordance with Norwegian consumer law, you have a 14-day right of withdrawal. At Cushion Day, we extend this to 60 days. Returned items must be unused, in their original packaging, and with all tags attached. The return shipping cost will be deducted from the refund amount (this also applies when exercising the right of withdrawal). Refunds are processed within 14 business days. Any attempt at misuse or fraud will be tracked and may be reported to the authorities.

Delay and Non-Delivery

If we fail to deliver on time, you have the right to withhold payment, demand delivery, cancel the agreement, or claim compensation. Claims must be submitted in writing.

Defects and Complaints

If an item has a defect not caused by you, you have the right to correction, replacement, price reduction, cancellation, or compensation. Complaints must be made within a reasonable time (two months is always considered reasonable). The complaint period is two or five years, depending on the expected lifespan of the item.

Seller's Rights in Case of Breach

If you breach the agreement, we have the right to withhold goods, demand fulfillment or cancellation, claim interest and collection fees, and charge a fee of NOK 150 for uncollected packages.

Warranty

Any warranties we provide are in addition to your statutory rights and do not limit them.

Discount Codes

Discount codes cannot be combined with other offers unless specifically stated. You are responsible for ensuring that discount codes are correctly applied during checkout.

Force Majeure

Cushion Day is not responsible for delivery issues caused by circumstances beyond our control, including strikes, pandemics, natural disasters, fire, or government orders.

Privacy and Security

We process your personal data in accordance with GDPR and Norwegian privacy legislation. Data is used solely to fulfill our agreement and will not be shared beyond what is necessary for delivery and payment. All payments are SSL-encrypted, and we do not store payment information.

Dispute Resolution

We aim to find good solutions to any disputes. Please send complaints to kundeservice@cushionday.no. If we cannot reach an agreement, you may contact the Norwegian Consumer Council (Forbrukerrådet) for mediation.
